f. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by the company).

g. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.

h. Your Contributions are not used to harass or threaten (legally) any person or promote violence against a specific person or class of people.

i. Your Contributions do not violate any applicable law, regulation, or rule.

j. Your Contributions do not violate the privacy or publicity rights of any third party.

k. Your Contributions do not violate laws concerning child pornography or the protection of minors.

l. Your Contributions do not include offensive comments related to race, national origin, gender, sexual preference, or physical handicap.

m. Your Contributions do not otherwise violate or link to material that violates any provision of these terms or applicable law.

Consequences of Violation: Using the services in violation of these rules may result in termination or suspension of your rights to use the services.

  1. Governing Law

Applicable Law: The Legal Terms and your use of the services are governed by the laws of the State of Ohio, applicable to agreements made and performed entirely within Ohio, without regard to its conflict of law principles.

  1. Dispute Resolution

Informal Negotiations:To expedite resolution and control costs, both parties (you and the company) agree to first attempt to negotiate any dispute (except those explicitly excluded) informally for at least 30 days before initiating arbitration. Informal negotiations begin upon written notice from one party to the other.

Binding Arbitration:If informal negotiations fail, disputes (except those excluded) will be resolved through binding arbitration under the Commercial Arbitration Rules and, where appropriate, the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association (AAA).

Arbitration will take place in Summit, Ohio, unless otherwise required by AAA rules or applicable law.

Arbitration will be conducted in person, by phone, or online, with the arbitrator issuing a written decision without providing reasons unless required by AAA rules.

You waive the right to sue in court or have a jury trial by agreeing to this provision.

Arbitration fees and costs will be governed by AAA Consumer Rules. If costs are deemed excessive, the company will pay all arbitration fees and expenses.

Court Jurisdiction: If a dispute proceeds in court instead of arbitration, it will be handled in state and federal courts in Summit, Ohio. Both parties consent to this jurisdiction and waive defenses of lack of personal jurisdiction and forum non conveniens.

Exclusions:The United Nations Convention on Contracts for the International Sale of Goods (CISG) and the Uniform Computer Information Transaction Act (UCITA) are excluded from these terms.

Statute of Limitations: Any dispute related to the services must be commenced within one year of the cause of action arising. If this limitation is deemed illegal or unenforceable, the dispute will be decided by a court of competent jurisdiction, with both parties agreeing to submit to its personal jurisdiction.

Restrictions:Arbitration is limited to disputes between the individual parties (no joinder, class-action basis, or representation of the general public or other persons).

Exceptions to Informal Negotiations and Arbitration: Disputes seeking to enforce or protect intellectual property rights, those related to theft, piracy, invasion of privacy, or unauthorized use, and claims for injunctive relief are not subject to informal negotiations or binding arbitration. These will be decided by a court of competent jurisdiction in Summit, Ohio, with both parties agreeing to submit to its personal jurisdiction.

Error Correction: The services may contain typographical errors, inaccuracies, or omissions (e.g., in descriptions, pricing, availability). The company reserves the right to correct these and update the information on the services at any time without prior notice.
